These terms of use (“Terms”) apply to your use of NationalLoans.com (the “site”), which is operated by National Loans USA (“we”, “us”). By using the site, you agree to these Terms. If you don’t agree, please don’t use the site. Our privacy policy explains how we handle your information and is part of these Terms.

1. What this site is

NationalLoans.com is an information site about borrowing in the United States. It has three parts:

• Guides and articles about loans, borrower rights and how to avoid scams
• A directory of lenders, banks and finance companies, with listings submitted by those businesses
• A loan request form, provided by an outside lead network, that sends your request to lenders and other partners

National Loans USA is not a lender. We don’t make loans or credit decisions, and we don’t broker loans ourselves. We don’t decide whether you get an offer or what its rate and terms will be.

2. Information only, not financial advice

Our content is general information for educational purposes. It is not financial, legal, tax or credit advice, and it doesn’t take your personal situation into account. Loan laws and products change, and rules differ from state to state. We try to keep our content accurate and up to date, but we can’t promise that every page is complete or current. Before you make a borrowing decision, read the lender’s terms carefully, and consider talking to a qualified professional or a nonprofit credit counselor.

3. No guarantee of approval, rates or terms

Using the site or sending a loan request doesn’t guarantee that you will get a loan offer, get approved, or get any particular rate, amount or term. Lenders decide whether to make an offer and set their own rates, fees and terms. These depend on the lender, your state, your credit and other factors. Lenders may check your credit. Any example rates or costs on the site are examples only, not offers.

4. Who can use the site

You must be at least 18 years old and a resident of the United States to use the loan request form. The site is intended for US residents. You agree that the information you give on the site, including on the loan request form, is true, accurate and your own.

5. The loan request form and your consent to be contacted

The loan request form on our apply now page is provided by ZeroParallel, an outside lead network. When you send the form, your information is sent to that network and shared with lenders and other partners in it, as described in our privacy policy. We may be paid when you send a request or are matched with a lender.

By submitting the loan request form, you agree to be contacted by lenders and other partners in the network about your request, including by calls and text messages that may use an automatic telephone dialing system or prerecorded or artificial voice messages, at the phone number you provide, as described in the form’s own consent language. Read that consent language before you submit. It controls what you are agreeing to. Message and data rates may apply. You can withdraw your consent to automated calls and texts at any time, for example by replying STOP to a text or telling the caller. You may also need to contact each lender or partner directly.

Any loan you get is an agreement between you and the lender, not National Loans USA. The lender’s terms, disclosures and privacy notice apply to that loan.

6. Third-party websites and lenders

The site links to websites, lenders and services run by other companies. We don’t control them and aren’t responsible for their content, products, practices or privacy policies. Your dealings with any lender or other third party are between you and that company. Check a lender’s license before you share personal information or sign anything. You can search for licensed lenders on NMLS Consumer Access and with your state’s financial regulator.

7. Directory listings

Businesses submit their own listings to our directory. Some listings are free, and some are paid placements (Silver and Gold packages). Paid listings may appear more prominently. A listing is not an endorsement or recommendation by National Loans USA.

Each business is responsible for the accuracy of its own listing, including its name, contact details, products, rates and licenses. We don’t verify every listing, including whether a business holds the licenses it needs in your state. We may edit, refuse or remove any listing at any time.

If you submit a listing, you confirm that you have the right to do so, that the information is accurate and not misleading, and that your business holds all licenses required for the products it offers.

8. Acceptable use

You agree not to:

• Use the site for any unlawful purpose or in violation of these Terms
• Give false information, or submit someone else’s information without their permission
• Submit listings or messages that are false, misleading, fraudulent, abusive or that infringe someone else’s rights
• Try to gain unauthorized access to the site, its servers or its data
• Interfere with the site’s operation, for example by sending malware, spam or excessive automated traffic
• Scrape, copy or collect content or data from the site using automated tools without our written permission

We may suspend or block access to the site for anyone who breaks these rules.

9. Intellectual property

The content on this site, including text, graphics, page layout and the National Loans USA name, belongs to National Loans USA or its licensors and is protected by copyright and other laws. You may view and print pages for your own personal, non-commercial use. You may not copy, republish, sell or create works based on our content without our written permission. Names and logos of other companies belong to their owners.

If you believe content on the site infringes your copyright, email info@nationalloans.com with the details, and we will review it.

10. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT ALLOWED BY LAW, WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON’T WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL CODE. WE DON’T ENDORSE OR GUARANTEE ANY LENDER, LISTING, PRODUCT OR OFFER.

11. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, NATIONAL LOANS USA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF MONEY, DATA OR OPPORTUNITY, ARISING FROM YOUR USE OF THE SITE, ANY CONTENT ON IT, ANY LISTING, OR ANY DEALINGS WITH A LENDER OR OTHER THIRD PARTY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT BE MORE THAN THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some states don’t allow certain limits on liability, so some of these limits may not apply to you.

12. Indemnity

You agree to defend, indemnify and hold harmless National Loans USA from any claims, losses, damages and costs, including reasonable attorneys’ fees, that arise from your breach of these Terms, your misuse of the site, information you submit, or a listing you submit.

13. Governing law

These Terms are governed by the laws of the United States and the state in which National Loans USA operates, without regard to conflict-of-law rules. This doesn’t take away any rights you have under the consumer protection laws of the state where you live.

14. Changes to these Terms

We may change these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. If you keep using the site after a change, you accept the updated Terms. If a court finds part of these Terms unenforceable, the rest stays in effect.
